These Terms and Conditions ("Terms") govern the use of Better Giving ("Platform", "we", "us", or "our"), an online fundraising platform operated in the United Kingdom. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

1. About the Platform

BetterGiving provides an online service that allows individuals, organisations, registered charities, and non-registered charities ("Fundraisers") to create fundraising campaigns and receive donations from members of the public ("Donors").

The Platform supports: i) Donation-based crowdfunding; and ii) Reward-based crowdfunding.

The Platform acts solely as a technical facilitator, not a trustee or guarantor. We do not raise funds on behalf of Fundraisers, control Campaigns, or take ownership of funds at any time. All funds raised through the Platform are transferred directly to the Fundraiser's nominated bank account.

2. Eligibility and International Use

The Platform is operated from the United Kingdom but is accessible globally.

To use the Platform, you must: i) Be at least 18 years old; ii) Have the legal capacity to enter into a binding contract under the laws applicable to you; iii) Not be prohibited from using the Platform under any applicable laws, sanctions, or regulations.

Users accessing the Platform from outside the UK do so on their own initiative and are responsible for compliance with all local laws, regulations, and tax obligations. Fundraisers are responsible for ensuring they are legally permitted to raise funds and receive donations.

3. Accessing the Platform and Account Security

We reserve the right to withdraw or amend this Platform, the Services, and any other material we provide on the Platform, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Platform is unavailable at any time or for any period.

To access the Platform or some of the resources it offers, you may be required to create an account and provide certain registration details or other information. It is a condition of your use of the Platform that all the information you provide is correct, current, and complete.

4. Account Registration

To create or manage a Campaign, you may be required to register an account and provide accurate, complete, and up-to-date information.

You are responsible for: i) Maintaining the confidentiality of your account credentials; and ii) All activity carried out under your account.

5. Fundraiser Responsibilities

By creating a Campaign, Fundraisers agree that they:

  • Will provide truthful, accurate, and not misleading information about the Campaign.
  • Will use all funds raised solely for the purpose described in the Campaign.
  • Are solely responsible for delivering any donation or promised rewards in donation-based or reward-based campaigns.
  • Will comply with all applicable laws, including charity, consumer protection, advertising, and tax laws.
  • Will maintain records relating to the use of funds and reward fulfilment.
  • Will provide records showing how funds were used and how rewards were fulfilled if requested by the platform.

6. Donor Responsibilities and Acknowledgements

By making a donation, Donors acknowledge and agree that:

  • Donations are made voluntarily and at the Donor's own risk.
  • It is the Donor's responsibility to assess the legitimacy, credibility, and suitability of a Campaign.
  • The Platform does not verify, endorse, or guarantee any Campaign.
  • Donations are not refundable, except where required by law.

Donors understand that Campaigns may fail, be delayed, or not deliver the intended outcomes or rewards.

8. Refunds, Chargebacks, and Payment Disputes

BetterGiving operates solely as a technology platform facilitating donations to independent fundraising organisers ("Fundraisers"). BetterGiving is not a charity, payment institution, or merchant of record.

All payments made through the BetterGiving platform are processed by Stripe ("Stripe") via Stripe Connect under the Direct Charge model.

Accordingly:

  • Donations are made directly by donors to Fundraisers.
  • Each Fundraiser is the merchant of record for their transactions.
  • Stripe provides payment processing services to Fundraisers.
  • BetterGiving does not receive, hold, control, or disburse donation funds, except for any clearly disclosed platform or application fees.

Refunds are the sole responsibility of the Fundraiser. Any request for a refund must be directed to the relevant Fundraiser. The Fundraiser has sole discretion to approve or deny refund requests, subject to applicable law.

8. Optional Tips

The Platform is free to use for both Fundraisers and Donors. Donors may choose, at their discretion, to leave an optional tip to support the operation and maintenance of the Platform. Tips: i) Are voluntary and not required to complete a donation; ii) Are paid to the Platform; iii) Are non-refundable.

8. Payments and Transfers

Payments are processed via third-party payment service providers. Payouts are made by bank transfer to your bank account, or by any other payment method you have selected via the Website, provided that you have successfully passed identity verification and any other required checks.

The Platform: does not hold or escrow funds; is not a payment service provider; and is not responsible for payment processing delays, failures, or errors caused by third parties.

9. Taxes and Cross-Border Compliance

Fundraisers are solely responsible for: i) Determining whether donations constitute taxable income in their jurisdiction; ii) Registering with, reporting to, and paying any applicable taxes to relevant authorities; iii) Complying with local fundraising, charity, consumer protection, and foreign exchange laws.

10. Prohibited Activities and Sanctions Compliance

You must not use the Platform for: i) Fraud, deception, or misrepresentation; ii) Illegal activities under UK law or the laws applicable to you; iii) Fundraising that violates international sanctions, export controls, or anti-money laundering regulations; iv) Hate, harassment, violence, or extremist content; v) Money laundering, terrorist financing, or circumvention of financial controls; vi) Infringement of intellectual property rights.

11. Monitoring, Enforcement, and Platform Discretion

While the Platform is not obligated to monitor Campaigns, we may implement proportionate and risk-based measures to detect fraud, misuse, or prohibited activities, comply with legal requests, and protect users and platform integrity.

12. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. We make no warranties or representations regarding campaign success, accuracy of Campaign content, or user conduct.

13. Limitation of Liability

To the maximum extent permitted by law, the Platform, its directors, officers, employees, and agents shall not be liable for losses arising out of or in connection with use of the Platform, including indirect, incidental, consequential, or economic losses.

14. Indemnity

You agree to indemnify, defend, and hold harmless the Platform, its directors, officers, employees, contractors, and agents from and against claims, damages, losses, liabilities, costs, and expenses arising out of your use of the Platform or breach of these Terms.

15. Integration with Social Media

We may provide social media integration features. By granting authorization, you assent to access and use in accordance with our Privacy Policy and applicable social platform policies.

16. Intellectual Property

All right, title, and interest in and to the Platform and related intellectual property are owned by BetterGiving, its licensors, or providers.

17. Trademarks

All BetterGiving names, logos, and marks are the property of BetterGiving or its affiliates/licensors. All other marks are property of their respective owners.

18. Data Protection and Privacy

Personal data is processed in accordance with our Privacy Policy and UK GDPR.

19. Termination

You may stop using the Platform at any time. We may suspend or terminate access without notice if you breach these Terms or applicable law.

20. Changes to These Terms

We may update these Terms from time to time at our discretion. Continued use after revised Terms are posted constitutes acceptance of those changes.

21. Governing Law, Jurisdiction, and Conflict of Laws

These Terms and any non-contractual obligations are governed by the laws of England and Wales, subject to mandatory consumer protections applicable in your country of residence.

Schedule 1 – Fundraiser Agreement

This Schedule forms part of the Terms and applies specifically to all Fundraisers.

1. Fundraiser Status

Fundraisers act in their own capacity and not as agents, partners, or representatives of the Platform.

2. Representations and Warranties

Fundraisers represent and warrant that: i) All information provided is accurate and not misleading; ii) They have legal authority to raise and receive funds; iii) Funds will be used solely for the stated purpose; iv) Rewards (if offered) will be delivered as described; v) Their Campaign complies with all applicable laws.

Schedule 2 – Reward-Based Crowdfunding Terms

1. Nature of Rewards Rewards are provided solely by Fundraisers.

2. Consumer Rights Where applicable, Donors may have statutory rights against Fundraisers.

3. Failure to Deliver May result in suspension but does not create refund obligations for the Platform.

Schedule 3 – Fraud, Misuse, and Trust Framework

1. Risk-Based Controls The Platform may employ proportionate controls.

2. Reporting Obligations Users must report suspected fraud or misuse promptly.

3. Enforcement The Platform may suspend accounts, restrict access, or cooperate with law enforcement.

Schedule 4 – Gift Aid and Tax Misrepresentation

1. Gift Aid May only be claimed by a UK-registered charity.

2. Misrepresentation Any false claim regarding tax relief constitutes a material breach of these Terms.

Schedule 5 – Dispute Resolution Escalation

1. Internal Resolution Parties agree to attempt good-faith resolution before legal proceedings.

2. Litigation Nothing prevents either party from seeking injunctive or equitable relief where necessary.
